1. Scope and acceptance

These Terms of Use ("Terms") govern access to and use of https://lumvo.ai, including its pages, content, forms, communications features and related online services ("Site").

The Site is published and operated by AATECH Singapore Pte. Ltd. (UEN: 201839939C), 10B Jalan Grisek, Singapore 419943 ("Lumvo.AI", "we", "us", "our").

By accessing or using the Site, you confirm that you have read, understood and agree to these Terms. If you use the Site for, or on behalf of, a company or other organisation, you represent that you have authority to bind that organisation. If you do not agree to these Terms, do not access or use the Site.

2. Purpose of the Site and no offer of services

The Site provides general information about Lumvo.AI's AI automation services for businesses in Singapore. Unless a page expressly states otherwise, Site content is provided for general information only. It is not a binding offer, service commitment, specification or professional advice.

Submitting a form, message or enquiry does not create a client, agency, consulting, software or other contractual relationship. A binding service engagement arises only when AATECH Singapore Pte. Ltd. expressly confirms it in a written agreement, accepted proposal, statement of work or other authorised written instrument. That instrument governs the relevant service and prevails over these Terms to the extent of any inconsistency.

3. Eligibility and authority

You must be at least 18 years old and legally capable of entering into these Terms. The Site is intended primarily for business, professional and commercial use.

You must provide accurate, current and complete information when using the Site, submitting an enquiry or otherwise interacting with us. You must promptly correct material inaccuracies in information you previously provided.

4. Permitted use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Site for legitimate personal or internal business purposes, including evaluating our services, making enquiries and accessing publicly available content.

You must not, and must not permit any other person to:

• use the Site in breach of applicable law, regulation, intellectual-property right, privacy right or contractual obligation;
• access, probe, scan, test or circumvent any security, authentication or access-control measure without our prior written consent;
• introduce malware, viruses, harmful code or other material that may impair, disrupt or compromise the Site or our systems;
• interfere with, overload or degrade the Site or its networks;
• use automated means, bots, crawlers, scrapers or similar technologies to extract, monitor or index Site content, except ordinary search-engine indexing we have not prohibited;
• copy, reproduce, modify, adapt, reverse engineer, republish, sell, rent, licence, distribute or create derivative works from any part of the Site or Site content, except where expressly permitted by mandatory law or our prior written consent;
• remove, obscure or alter copyright, trade-mark or other legal notices;
• impersonate another person or organisation, misrepresent your affiliation, submit false or misleading information or attempt to obtain information through deception;
• use Site content to develop, train, test, benchmark or improve a competing service, database, model or product without our prior written agreement;
• use the Site to send unsolicited marketing, spam or other unauthorised communications; or
• use the Site in a manner that may damage our reputation, business, systems, rights or relationships.

5. Technology and digital service descriptions

Descriptions of Lumvo.AI's software, AI automation, workflow, outreach or related services are indicative only unless expressly incorporated into a written agreement. Demonstrations, prototypes, case studies, capability statements and forward-looking statements do not create a commitment to deliver a particular feature, integration, result, timeline, performance level or compatibility outcome.

Any software licence, subscription, implementation, maintenance, support, professional service or data-processing obligation will be governed by the relevant written agreement, including any service description, statement of work and data processing addendum.

6. Enquiries and contact form submissions

You may submit information, messages, feedback or other materials through the Site's contact form, WhatsApp link or email ("User Submissions"). You retain ownership of your User Submissions, subject to the rights you grant below.

You represent and warrant that:

• you have all rights, permissions and consents needed to provide the User Submissions to us;
• your User Submissions are accurate to the best of your knowledge and do not infringe another person's rights or violate applicable law;
• your User Submissions do not contain malware, harmful code, unlawful content or personal data that is unnecessary for the purpose of your enquiry; and
• where you submit personal data about another person, you have provided any required notices and obtained any required authority or consent.

You grant us a non-exclusive, royalty-free right to use User Submissions only as reasonably necessary to respond to your request, evaluate or provide a service, maintain security and meet legal obligations.

7. Intellectual property

The Site and all content made available through it, including text, graphics, logos, trade marks, designs, software, documents and other materials ("Site Content") are owned by or licensed to AATECH Singapore Pte. Ltd. and are protected by intellectual-property and other laws.

Except for the limited licence in Section 4, no right, title or interest in the Site or Site Content is granted to you. You may not use Lumvo.AI or AATECH names, logos, trade marks or branding without our prior written approval.

If you believe Site Content infringes your intellectual-property rights, contact hello@lumvo.ai with sufficient detail to identify the work, the allegedly infringing material, your ownership or authority and your contact information.

8. Third-party websites and services

The Site may link to or integrate with third-party websites, communications channels (including WhatsApp), analytics tools, form services, and other third parties ("Third-Party Services"). Third-Party Services are provided for convenience only. We do not control, endorse or guarantee their content, availability, security, legality, accuracy or privacy practices. Your use of a Third-Party Service is governed by that third party's own terms and policies.

9. Privacy, cookies and electronic communications

Our collection and processing of personal data is governed by the Lumvo.AI Privacy Policy and Cookie Policy published on this Site.

You agree that we may communicate with you electronically, including by email, WhatsApp, website notices or other electronic means, where permitted by applicable law and where you have provided your contact details for this purpose.

10. Availability and changes to the Site

We may update, modify, suspend, restrict, withdraw or discontinue all or part of the Site or any Site Content at any time, with or without notice. We do not guarantee that the Site will be uninterrupted, timely, secure, error-free or available at all times.

11. Disclaimer of warranties

To the fullest extent permitted by applicable law, the Site and Site Content are provided on an "as is" and "as available" basis. We disclaim all representations, warranties, conditions and guarantees, whether express, implied, statutory or otherwise, including warranties of accuracy, completeness, reliability, merchantability, fitness for a particular purpose and non-infringement.

Nothing in these Terms excludes or restricts a warranty, representation, condition or right that cannot lawfully be excluded or restricted.

12. Limitation of liability

To the fullest extent permitted by applicable law, AATECH Singapore Pte. Ltd. and its directors, officers, employees, representatives, contractors, licensors and service providers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive loss or damage; loss of profit, revenue, business, opportunity, goodwill, data or business interruption arising out of or in connection with the Site, Site Content, User Submissions, Third-Party Services or these Terms.

To the fullest extent permitted by applicable law, our aggregate liability arising out of or in connection with the Site, Site Content or these Terms will not exceed SGD 100.

The exclusions and limitations in this Section do not exclude or limit liability for fraud or fraudulent misrepresentation, death or personal injury caused by negligence, wilful misconduct, or liability that cannot lawfully be excluded or limited.

13. Indemnity for business users

If you access or use the Site in the course of business, trade, profession or on behalf of an organisation, you will indemnify and hold harmless AATECH Singapore Pte. Ltd. and its directors, officers, employees, representatives, contractors and service providers against claims, losses, liabilities, damages, costs and expenses (including reasonable legal fees) arising from or in connection with: (a) your breach of these Terms; (b) your User Submissions; (c) your breach of applicable law or third-party rights; or (d) your misuse of the Site.

14. Suspension and termination

We may suspend, restrict or terminate your access to all or part of the Site without notice if we reasonably believe that you have breached these Terms, created a security or legal risk, submitted harmful or unlawful material, or interfered with the Site.

15. Changes to these Terms

We may revise these Terms from time to time to reflect changes in the Site, services, technology or applicable law. The latest version will be posted on the Site with an updated effective date. Your continued use of the Site after that date constitutes acceptance of the revised Terms.

16. Governing law and jurisdiction

These Terms and any non-contractual obligations arising out of or in connection with them are governed by the laws of the Republic of Singapore, without regard to conflict-of-laws principles. The courts of Singapore have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.

17. General provisions

Entire agreement. These Terms, together with the Privacy Policy and Cookie Policy, form the entire agreement between you and AATECH Singapore Pte. Ltd. concerning your use of the Site.

Severability. If any provision is held invalid or unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions remain in full force.

No waiver. A failure or delay to exercise a right or remedy does not waive that right or remedy.

Assignment. You may not assign your rights or obligations under these Terms without our prior written consent.

Language. These Terms are prepared in English. If a translation is provided, the English version prevails in the event of any inconsistency.
